Overview

These Terms of Service ("Terms") govern your access to and use of the EdibleFactor application and website (the "Service"), operated by EdibleFactor ("we", "our", "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use EdibleFactor. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Account Registration

  • You may sign in using Google OAuth or continue as a guest.
  • You are responsible for maintaining the confidentiality of your account.
  • You agree to provide accurate, current information during onboarding (age, weight, height, activity level).
  • Guest accounts are temporary (24-hour session) and do not persist data across devices.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

    • 3. The Service

    EdibleFactor provides:

  • AI-powered meal recommendations based on your calorie and budget targets
  • Nutritional macro tracking (calories, protein, carbohydrates, fat)
  • Menu scanning via camera OCR with estimated nutritional values
  • Restaurant menu browsing for partner restaurants in Bangalore
  • Subscription plans (SmartDine Pro, SmartDine Elite) with premium features

    • The Service is currently available for the Bangalore market. Coverage may expand over time.

    4. Nutritional Information Disclaimer

    IMPORTANT — PLEASE READ CAREFULLY:

  • All calorie counts, macro values, and nutritional information displayed in EdibleFactor are estimates only.
  • These values are not certified by FSSAI (Food Safety and Standards Authority of India) or any regulatory body.
  • Estimates are based on standard portion sizes and typical preparation methods. Actual nutritional content may vary based on restaurant preparation, ingredients, and serving size.
  • EdibleFactor is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
  • Always consult a qualified healthcare professional or registered dietitian before making significant dietary changes, especially if you have medical conditions such as diabetes, heart disease, or food allergies.
  • We do not guarantee the accuracy of nutritional data provided by partner restaurants or extracted via menu scanning.

    • 5. AI Assistant Disclaimer

  • The EdibleFactor AI assistant (powered by Google Gemini) provides meal suggestions based on your profile and available menu data.
  • AI recommendations are not professional dietary advice.
  • The AI may occasionally produce inaccurate or inappropriate suggestions. Always verify recommendations against your personal health requirements.
  • We are not liable for any health outcomes resulting from following AI-generated recommendations.

    • 6. Subscriptions & Payments

  • Free tier: Basic meal tracking and AI chat with limited features.
  • SmartDine Pro (₹499/month): Unlimited AI scans, precision tracking, budget optimisation.
  • SmartDine Elite (₹999/month): Everything in Pro plus personal nutritionist chat, custom meal plans, early access.

    • Billing:

  • Subscriptions are billed monthly via Razorpay.
  • All prices are in Indian Rupees (INR) and inclusive of applicable taxes.
  • You may cancel at any time; access continues until the end of the current billing period.
  • Refunds are processed in accordance with Razorpay's refund policy and applicable consumer protection laws.

    • App Store Purchases:

  • If you purchase a subscription through Apple App Store or Google Play Store, the respective store's billing terms and refund policies apply.
  • In-app purchase prices may differ from web prices due to platform fees.

    • 7. Acceptable Use

    You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Scrape, crawl, or harvest data from the Service
  • Upload malicious content or attempt to compromise system security
  • Impersonate another person or misrepresent your affiliation
  • Use the Service to provide medical or dietary advice to others commercially
  • Circumvent any access controls, rate limits, or security measures

    • 8. Intellectual Property

  • The EdibleFactor name, logo, UI designs, and underlying code are our intellectual property.
  • Restaurant names, logos, and menu items are the property of their respective owners.
  • You retain ownership of any personal data you provide but grant us a limited licence to use it for Service operation as described in our Privacy Policy.

    • 9. Limitation of Liability

    To the maximum extent permitted by applicable Indian law:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
  • We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or ₹5,000, whichever is greater.

    • 10. Indemnification

    You agree to indemnify and hold harmless EdibleFactor, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

    11. Governing Law & Disputes

  • These Terms are governed by the laws of India.
  • Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
  • Before pursuing legal action, both parties agree to attempt resolution through good-faith negotiation for a period of 30 days.

    • 12. Changes to These Terms

    We may update these Terms from time to time. Material changes will be communicated via the app or email. Continued use of the Service after changes constitutes acceptance. If you disagree with updated Terms, you should discontinue use and delete your account.
